Privacy statement for the person concerned: art. 13 of the Privacy Policy (d. lgs. 196/2003) Privacy statement represents the main fulfilment that protects the person concerned, since it is aimed to:
- let the person concerned know the purposes and methods of the use of personal information
- guarantee the obligation of the information conferment
- guarantee the opportunity to exercise the rights that the law gives to the person concerned with the privacy policy.
Agreement for the use of the personal information provided – art. 23-24 Privacy Policy
Privacy policy sets the obligation to have a previous agreement of the person concerned prior to use his personal information. The agreement has to be stated:
- Freely;
- Through a specific procedure;
- With a written statement.
The agreement is effective if a privacy statement precedes it.
The obligation to have a previous agreement is not needed in case the use concerns:
- Information coming from public records, lists, deeds or documents that anyone can access;
- Information related to the development of economic businesses.
